Studio Halo Platform Data, Output, and Methodology Terms

This Policy allocates rights in Customer Data, AI Inputs, outputs, Halo Scores, Derived Data, Benchmark Data, models, and proprietary scoring methodologies and is incorporated into the Studio Halo Terms of Service.
Hanna Creative Co., a Massachusetts corporation, operates the Studio Halo platform and offers services under the HALO SCORE brand.
This AI, Data & Intellectual Property Rights Policy (this "Policy") is incorporated into and forms part of the Studio Halo Terms of Service (the "Terms") between Hanna Creative Co., a Massachusetts corporation ("Hanna Creative," "Company," "we," "us," or "our"), and each Customer and Authorized User. Hanna Creative operates the Studio Halo platform and offers services under the HALO SCORE brand. Capitalized terms not defined here have the meanings in the Terms.
This Policy governs ownership, licensing, permitted processing, artificial intelligence, scoring, benchmarking, outputs, model improvement, confidentiality, and protection of proprietary methods associated with the Services. Personal data is also handled as described in the Privacy Policy. If this Policy conflicts with the Terms, this Policy controls with respect to the subjects it expressly addresses, unless an Order expressly states otherwise.
The Services are designed primarily for the interior design industry and may collect and analyze Customer-provided information and information from websites, social media, search and marketing platforms, analytics tools, public sources, licensed sources, traditional and digital media sources, and third-party integrations. The Services may combine standard quantitative metrics with proprietary qualitative, cultural-recognition, editorial, and interpretive analysis to generate Halo Scores, indexes, benchmarks, dashboards, visualizations, and recommendations relating to brand visibility, resonance, prestige, marketing performance, and related business attributes.
The parties intend the following allocation:
"AI Feature" means a feature, function, or component of the Services that incorporates, uses, depends on, or employs machine learning, statistical learning, generative AI, large language models, neural networks, or other artificial intelligence technology.
"AI Input" means Customer Data, prompts, instructions, queries, configuration choices, and other information processed by or through an AI Feature.
"Aggregated Data" means information combined with data from other sources or customers so that it does not reasonably identify a specific individual or Customer.
"Authorized User" means a person Customer authorizes to access and use the Services under the Terms.
"Benchmark Data" means aggregated, comparative, normalized, statistical, cohort-based, industry-level, or cross-reference data and analytics used to establish baselines, compare performance, identify trends, calibrate scoring, or improve recommendations. In the current implementation, cross-customer industry reference benchmarks are derived from independently sourced public or third-party reference data, including press-source domain-authority information, and do not incorporate Customer-connected analytics, search, or social data.
"Customer Content" means information, materials, business details, brand information, prompts, instructions, corrections, Feedback, and other content submitted, entered, transmitted, or otherwise made available by or on behalf of Customer through the Services. Customer Content includes data obtained from Customer-authorized connected systems. The current Service does not provide a general customer file-upload feature.
"Customer Data" means Customer Content and data obtained from Customer Systems or Customer-authorized integrations for Customer's use of the Services. Customer Data does not include Third-Party Data obtained independently by Hanna Creative, Usage Data, Derived Data, Benchmark Data, or Studio Halo Technology.
"Customer-Facing Output" means a dashboard, narrative recommendation, visualization, or other material made available to Customer through the Services and, if a feature is expressly made available, a report, export, badge, or similar shareable item. Customer-Facing Output may display a Halo Score, Derived Data, Benchmark Data, or Third-Party Data but does not include underlying Studio Halo Technology.
"Customer System" means a website, social media account, analytics account, advertising platform, CRM, marketing platform, or other system or account that Customer connects to or authorizes Hanna Creative to access.
"De-Identified Data" means data processed so that it cannot reasonably be linked to an identified or identifiable individual or Customer, taking into account reasonably available means, and maintained without attempting to re-identify it except as permitted by law to test de-identification controls.
"Derived Data" means data, measurements, features, transformations, inferences, classifications, relationships, trends, scores, rankings, recommendations, indexes, and other information generated, calculated, inferred, normalized, or derived by or through the Services from Customer Data, Third-Party Data, Usage Data, or combinations of them. Derived Data does not include Customer Data in its original form.
"Feedback" means suggestions, ideas, requests, comments, corrections, evaluations, and other feedback concerning the Services, Studio Halo Technology, or outputs.
"Halo Score" means a score, index value, rating, ranking, classification, or related measure generated by the Services using Hanna Creative's proprietary methodologies, including the selection, normalization, weighting, and synthesis of quantitative metrics and qualitative or interpretive factors, to assess brand visibility, resonance, prestige, cultural recognition, marketing performance, or related attributes.
"Studio Halo Technology" means the Services and all related software, AI Features, models, algorithms, formulas, methodologies, weighting systems, taxonomies, ontologies, qualitative assessment and cultural-recognition frameworks, interpretive rubrics, curated recommendation and explanation libraries, narrative templates and original written expression, prompts, prompt libraries, workflows, feature engineering, embeddings, model parameters, hyperparameters, interfaces, designs, documentation, know-how, inventions, trade secrets, and improvements, including the methodology underlying any Halo Score. Studio Halo Technology does not include an abstract idea, general writing style, or other matter that is not protectable under applicable law, but Hanna Creative retains all rights in its protectable expression, compilations, methods, and confidential know-how.
"Third-Party Data" means data, content, materials, metrics, or information obtained from third-party services, APIs, licensed datasets, public sources, media sources, or integrations, whether accessed independently by Hanna Creative or at Customer's direction.
"Usage Data" means technical, operational, diagnostic, performance, telemetry, interaction, and usage information relating to access to and use of the Services, excluding Customer Content in its original form.
3.1 Customer Data. As between Customer and Hanna Creative, Customer retains all right, title, and interest it lawfully holds in Customer Data in its original form. Except for the licenses expressly granted in the Agreement, no ownership interest in Customer Data is transferred to Hanna Creative.
3.2 Rights and Permissions. Customer represents and warrants that it has all rights, permissions, notices, consents, lawful bases, and authority necessary for Hanna Creative, its Affiliates, and its service providers to collect, access, host, copy, transmit, transform, analyze, combine, display, and otherwise process Customer Data and Customer Systems as contemplated by the Agreement. Where Customer processes personal data on behalf of a third-party Controller, Customer also represents that its instructions reflect that Controller's lawful instructions and authorize Hanna Creative to act as a Subprocessor.
3.3 Customer Restrictions. Customer will not submit or connect content that is unlawful, misleading, infringing, misappropriated, confidential to a third party without authorization, or subject to restrictions that prevent the contemplated processing. Customer is responsible for account permissions, connected-system terms, and instructions given to Hanna Creative.
3.4 Sensitive Data. Unless expressly authorized in an Order, Customer will not submit sensitive or highly regulated data, including government identifiers, payment-card data, health or biometric data, precise geolocation, or information about children.
4.1 Service License. Subject to applicable law, source-specific restrictions, and Schedule 1 to the Terms, Customer grants Hanna Creative and its service providers a worldwide, non-exclusive, royalty-free license during the subscription term and a reasonable transition, security, and deletion period afterward to host, store, reproduce, access, retrieve, transmit, display, format, normalize, organize, combine, compare, analyze, transform, and otherwise process Customer Data solely to provide, configure, operate, support, maintain, secure, troubleshoot, and improve Customer-specific Services; authenticate users; administer integrations; generate Customer-Facing Outputs and Halo Scores for Customer; prevent fraud and misuse; comply with law; and carry out Customer instructions. This Service License does not grant a right to use Customer Data for generalized cross-customer model training or benchmarking except through a separate affirmative authorization.
4.2 Customer-Directed Sharing. Customer also authorizes Hanna Creative to disclose Customer Data and outputs to Authorized Users, Customer-designated recipients, and Customer-selected integrations as necessary to carry out Customer's instructions.
4.3 No Unrelated Use. Except as expressly provided in this Policy or authorized by Customer, Hanna Creative will not use non-public Customer Data to advertise unrelated third-party products or to develop a separate customer profile unrelated to the Services.
5.1 Source Rights. Third-Party Data remains owned or controlled by its source or other rights holders. Public availability is not equivalent to unrestricted permission to scrape, retain, combine, redistribute, benchmark, or commercialize information. Neither the Agreement nor Hanna Creative's use of a collection intermediary expands rights against an original platform, publisher, profile owner, or other rights holder. Customer receives only the rights, if any, permitted by the applicable source terms, license, law, and Service functionality.
5.2 Customer-Authorized Integrations. Customer authorizes Hanna Creative to access data made available through Customer Systems and integrations. Customer is responsible for maintaining valid accounts and permissions and complying with applicable terms. Hanna Creative may rely on permissions presented by the integration unless it has actual knowledge that they are invalid.
5.3 Public, Licensed, and Commercial Sources. Hanna Creative may obtain information from public websites and social-media pages, publications, directories, RSS or metadata feeds, analytics or authority providers, data vendors, and other sources where Hanna Creative reasonably believes the contemplated use is permitted. Current public-source features may include business/social profile and post-level metadata, news headline/source/link/date metadata, and domain-authority reference scores. Hanna Creative may not be able to provide source-level rights beyond those it lawfully holds and may suspend a source when rights are uncertain or challenged.
5.4 Source Provenance and Use Limits. Hanna Creative will use Third-Party Data only to the extent permitted by applicable law, source terms, customer authorizations, and licenses that govern the applicable source. Hanna Creative may maintain source-rights records or a data-source matrix describing access method, storage, retention, combination, benchmarking, display, redistribution, attribution, correction, and model-improvement restrictions. Public availability does not, by itself, establish an unrestricted right to scrape, retain, combine, publish, or train on information.
5.5 Changes and Removal. A source may change, restrict, correct, remove, or withdraw data or access. Hanna Creative may modify, replace, suspend, or discontinue a source or integration if access becomes unavailable, restricted, unreliable, unlawful, or commercially unreasonable. These changes may affect current and historical outputs.
5.6 Independent Controller Processing. To the extent Hanna Creative independently obtains personal or business information from public, licensed, or commercially available sources and determines the purposes and means of processing, Hanna Creative acts as an independent Controller, Business, or similar responsible entity under applicable law. Hanna Creative may use such information to operate and improve the Halo Score, verify and normalize business information, maintain data quality, create industry benchmarks, conduct research, generate non-customer-specific insights, prevent misuse, and support the other lawful purposes described in the Privacy Policy. Independently sourced information does not become Customer Data solely because it is combined with Customer Data or displayed in a Customer-facing output.
5.7 Correction, Removal, and Source Challenges. Hanna Creative may provide a process for individuals and organizations to report materially inaccurate, outdated, misattributed, or allegedly unauthorized information obtained from public, licensed, or third-party sources. Hanna Creative may verify the requester, review supporting documentation, consult the underlying source, correct or remove information where appropriate, and recalculate affected outputs where reasonably practicable. A correction, removal, or recalculation request does not require Hanna Creative to disclose its source arrangements, selection criteria, models, weights, prompts, methodology, or trade secrets and does not guarantee removal of information Hanna Creative may lawfully retain or that remains available from an independent source.
5.8 Customer-Connected Google Data. Data received from Google API Services, including data received through Google Analytics 4 and Google Search Console connections, is subject to the Google API Services User Data Policy and applicable Limited Use requirements. Such raw, aggregated, anonymized, or derived data will be used only to provide or improve the customer-facing feature for which access was granted; will not be sold; will not be used to train, fine-tune, or improve a generalized AI or machine-learning model or cross-customer benchmark; and will be transferred or accessed by people only as permitted by the applicable Google policy.
5.9 Customer-Connected Instagram Data. Customer-connected Instagram Business data will be used for the connected Customer's own analytics and reporting experience and will not be resold or redistributed as a standalone dataset. Collection is designed to stop when the connection is revoked or invalidated. Hanna Creative will implement and maintain provider-required deletion and disconnection mechanisms as necessary to comply with applicable Meta terms and policies and may discontinue the integration if continued compliance cannot reasonably be maintained.
5.10 Public-Social and Other Automated Collection. Hanna Creative will not represent that a third-party scraping or collection vendor gives Hanna Creative rights that the original platform or rights holder did not grant. A public-social or automated-collection feature may be disabled, migrated to an authorized API, narrowed, or removed if source terms prohibit the collection or if storage, redistribution, thumbnail use, or benchmarking rights are not adequately supported.
6.1 Studio Halo Technology. As between the parties and to the extent protectable, Hanna Creative owns all right, title, and interest in and to Studio Halo Technology and all related intellectual property rights. This includes source and object code, software architecture, algorithms, models, formulas, weighting systems, taxonomies, qualitative assessment and interpretive frameworks, cultural-recognition rubrics, curated recommendation and explanation libraries, narrative templates and original written expression, prompt libraries, workflows, feature engineering, embeddings, interfaces, visual design, documentation, know-how, trade secrets, and improvements.
6.2 Proprietary Analytics and Contractual Rights. Subject to Customer's ownership of Customer Data in its original form and third-party rights in Third-Party Data, Hanna Creative owns all protectable right, title, and interest in Derived Data, Benchmark Data, Aggregated Data, Usage Data, Halo Scores, indexes, rankings, classifications, analytical structures, methodologies, and improvements generated by or through the Services. Whether or not a particular score, fact, or output is independently protectable under intellectual property law, Customer agrees that Hanna Creative retains the exclusive contractual right to create, calculate, maintain, calibrate, reproduce, distribute, license, and commercialize the Halo Score system and its underlying methodology, subject to the Customer license in Section 7.
6.3 Customer Confidentiality. Hanna Creative's ownership of Customer-specific Derived Data or a Halo Score does not make a non-public customer-specific output public. Hanna Creative will treat non-public Customer-specific outputs as Customer Confidential Information and will disclose them only as permitted by the Agreement, Customer instructions, or law.
6.4 No Transfer of Raw Data. Hanna Creative does not claim ownership of Customer Data in its original form, raw facts that are not protectable, or Third-Party Data owned by another party. Ownership provisions allocate contractual rights between Customer and Hanna Creative and do not expand either party's rights against a third-party owner.
7.1 Proprietary and Evaluative Nature. A Halo Score and related ranking, index, benchmark, classification, explanation, and recommendation reflect Hanna Creative's proprietary selection, transformation, weighting, normalization, qualitative assessment, interpretive synthesis, methodology, and judgment. The score is an evaluative estimate or opinion, not an objectively verifiable fact that a brand is definitively prestigious, resonant, visible, valuable, or superior. Disclosure of a result does not disclose or license the underlying formula, model, source code, weights, prompts, workflow, recommendation library, or trade secret.
7.2 Customer License. Subject to the Agreement, Hanna Creative grants Customer a non-exclusive, worldwide, royalty-free license to use, reproduce, and internally distribute Customer-Facing Outputs made available through the Services for Customer's business operations, planning, strategy, presentations, and communications. Customer may download or share an unaltered customer-specific output only where the Service, applicable plan, or Order makes that functionality available and may share it with employees, advisers, investors, clients, agencies, or other business partners who have a legitimate need to review it.
7.3 Public Use. Customer may publicly display a Halo Score or output only where: (a) the Service provides a designated shareable output; (b) Hanna Creative has approved the format; or (c) the applicable plan or Order expressly permits publication. Public use must be accurate, unaltered, not misleading, include the applicable "as of" date or version where provided, and comply with Hanna Creative's brand guidelines. Customer may not imply endorsement, certification, or guaranteed performance beyond the output's stated meaning.
7.4 No Resale or Competing Dataset. Unless an Order expressly permits it, Customer may not sell, sublicense, license as a standalone product, create a commercial database from, or provide subscription access to Customer-Facing Outputs, Halo Scores, Benchmark Data, or Derived Data. Customer may not use outputs to build a competing score, index, model, analytics product, or benchmark.
7.5 Non-Exclusivity and Protectability. Outputs may be similar or identical for different customers or inputs. AI-generated or data-driven output may not qualify for copyright or other protection. Hanna Creative does not promise exclusivity, uniqueness, registrability, or ownership of every element of an output. Customer's license is subject to third-party rights in Third-Party Data and materials incorporated into an output.
7.6 Underlying Facts, Dates, and Review. Factual source information displayed with or used in an output may be incomplete, delayed, disputed, or incorrect and is analytically distinct from the evaluative Halo Score. Where reasonably practicable, a score or shareable output should identify an as-of date, version, or relevant limitation. A verified correction or source challenge may result in correction, removal, or recalculation, but does not entitle a requester to the methodology, weights, source arrangements, or trade secrets.
8.1 Customer-Specific Processing. Hanna Creative may process AI Inputs and Customer Data to generate outputs for Customer, perform Customer-specific classification and report generation, troubleshoot, evaluate quality, and maintain security. The current architecture uses stateless API inference and stores Customer-specific generated report content in the Studio Halo application. It does not maintain a vector database, embeddings, a retrieval-augmented-generation index, or a fine-tuning pipeline.
8.2 No Generalized Training on Customer Data. Hanna Creative does not currently use Customer Data, including identifiable, customer-identifying, aggregated, or de-identified Customer Data derived from customer-connected analytics, search, or social accounts, to train, fine-tune, calibrate, or improve a model, scoring system, cross-customer benchmark, or product for unrelated customers. Current industry reference benchmarks are derived from independently sourced public or third-party reference data. Usage Data and Feedback may be used for security, service operations, usability, and product administration but may not be used as a workaround to reconstruct Customer Data or create a broader training right.
8.3 Future Broader Use Requires Affirmative Authorization. Hanna Creative will not broaden the use described in Section 8.2 through a quiet or retroactive policy amendment. Any future use of identifiable, customer-identifying, aggregated, or de-identified Customer Data for generalized cross-customer model, scoring, benchmark, or product improvement will require a separate affirmative, informed authorization, Order, or other valid legal basis that describes the new use and applies prospectively.
8.4 Third-Party AI Providers and Subprocessors. Hanna Creative currently uses Anthropic's commercial Claude API for limited classification and Customer-specific report generation. According to Anthropic's current commercial privacy materials, commercial API inputs and outputs are not used to train Anthropic models by default and standard API inputs and outputs are automatically deleted from Anthropic's backend within 30 days, subject to stated safety, legal, and account-specific exceptions. In the reviewed configuration, Anthropic Files API usage contains Hanna Creative report templates and prompt instructions rather than Customer Data. Hanna Creative does not represent that zero-data-retention terms apply unless separately confirmed. Other material subprocessors are identified in Schedule 1 to the Terms or the applicable subprocessor list.
8.5 No Customer-Data Training Artifact. Because the current Service does not train or fine-tune a generalized model on Customer Data, deletion of Customer Data does not ordinarily require model "unlearning." This provision does not limit deletion obligations for stored Customer Data, Customer-specific outputs, or processing artifacts under the Privacy Policy, Schedule 1, or applicable law.
8.6 No Transparency That Reveals Trade Secrets. Hanna Creative may provide high-level information about data categories, controls, and providers where appropriate, but is not required to disclose model weights, source code, prompts, trade secrets, proprietary datasets, vendor-confidential information, or information that would compromise security or third-party rights.
8.7 Beta and Pilot Data. During a beta or pilot, Hanna Creative may access Customer Data and Customer-specific outputs only as reasonably necessary for support, debugging, quality assurance, and validation of that Customer's own account, unless Customer separately gives affirmative written authorization for a broader stated use. Beta participation alone does not authorize cross-customer training, prompt tuning based on identifiable Customer Data, or use of Customer-connected source data for generalized benchmarks.
8.8 Authorized Human Access and Quality Escalation. Authorized personnel and service providers may access AI Inputs, Customer Data, and customer-specific outputs where reasonably necessary for support, debugging, security, misuse investigation, quality evaluation, correction review, legal compliance, or Customer instructions. Access is subject to confidentiality, role-based or least-privilege controls, and logging or review where appropriate. Hanna Creative does not promise zero human access and will not conduct routine human review of Customer Content except as disclosed, authorized, or reasonably necessary for those purposes.
9.1 Permitted Uses. Subject to applicable law, source-specific restrictions, Schedule 1, and confidentiality obligations, Hanna Creative may create, retain, and use independently sourced Benchmark Data, Usage Data, non-customer-identifying operational statistics, and Derived Data necessary to provide Customer-specific Services. Hanna Creative may not use Customer-connected analytics, search, or social data, whether raw, aggregated, or de-identified, for generalized cross-customer model training or benchmarking without separate affirmative authorization. Customer-identifying Derived Data and Customer-specific Halo Scores may be used to provide, support, secure, evaluate, and improve the Services for that Customer, carry out Customer instructions, enforce the Agreement, or comply with law, but will not be published or commercialized in a way that identifies Customer without permission.
9.2 De-Identification Commitments and Public Commitment. Hanna Creative publicly commits to maintain and use De-Identified Data in de-identified form. Hanna Creative will take reasonable measures designed to ensure that De-Identified Data cannot be associated with an identified or identifiable individual or Customer, will not attempt to re-identify it except as permitted by law to test and validate de-identification controls, and will contractually require recipients to comply with materially equivalent restrictions. Where required by applicable law, Hanna Creative will exercise reasonable oversight of recipient compliance and take appropriate steps to address a breach of those restrictions.
9.3 Published Industry Insights. Hanna Creative may publish industry-level trends, statistics, indexes, insights, or benchmarks derived from independently sourced public or licensed reference data or other information Hanna Creative is lawfully permitted to publish, provided the publication does not identify Customer or disclose Customer Confidential Information. Hanna Creative will obtain permission before naming Customer or presenting a non-public Customer-specific result as a case study or endorsement.
Customer may voluntarily provide Feedback. To the extent Customer owns rights in Feedback, Customer assigns to Hanna Creative all right, title, and interest in the Feedback. If an assignment is not effective, Customer grants Hanna Creative a perpetual, irrevocable, worldwide, transferable, sublicensable, royalty-free license to use, reproduce, modify, create derivative works from, commercialize, and otherwise exploit Feedback for any lawful purpose without attribution or compensation. Customer will not provide Feedback it considers confidential or proprietary unless the parties agree otherwise in writing.
Hanna Creative owns improvements, modifications, configurations, and derivative works of Studio Halo Technology created from Feedback, usage, support, testing, or service operation, even if Customer requested or suggested them, subject to Customer's ownership of Customer Data in its original form.
Customer will not, and will not permit any person to, directly or indirectly:
12.1 Hanna Creative Confidential Information. Non-public Studio Halo Technology, including methodologies, weights, model parameters, qualitative and interpretive frameworks, cultural-recognition rubrics, recommendation and explanation libraries, prompts, workflows, technical documentation, security information, roadmaps, data-source arrangements, and non-public Benchmark Data, is Hanna Creative Confidential Information and may constitute trade secrets.
12.2 Customer Confidential Information. Non-public Customer Data and non-public customer-specific outputs are Customer Confidential Information. Hanna Creative may use and disclose them only as permitted by the Agreement, Customer instructions, or law.
12.3 Safeguards. Each party will protect the other's Confidential Information using at least reasonable care and no less than the care it uses for its own similar information. Disclosure is limited to personnel, contractors, advisers, and service providers who need to know and are bound by confidentiality duties.
12.4 Generative AI Tools. Customer will not submit Hanna Creative Confidential Information or non-public outputs to a publicly available generative AI tool, or to an AI tool whose terms permit unrelated training or third-party disclosure, without Hanna Creative's written approval. Hanna Creative will apply the same principle to Customer Confidential Information.
12.5 Remedies. Unauthorized use or disclosure of proprietary methodology or trade secrets may cause irreparable harm. Hanna Creative may seek injunctive and equitable relief in addition to contractual and legal remedies.
12.6 Survival. Confidentiality obligations concerning trade secrets survive for so long as the information remains a trade secret under applicable law. Other confidentiality obligations survive for five years after disclosure or termination, unless a longer period is required by an Order or applicable law.
The Services use automated, statistical, and AI-assisted methods and may combine quantitative data with qualitative, cultural-recognition, editorial, and interpretive judgment. Halo Scores, benchmarks, analytics, and recommendations may be incomplete, inaccurate, delayed, non-unique, or affected by data quality, source availability, refresh timing, model behavior, methodology changes, market conditions, and subjective judgment. Data sources may refresh on different schedules, so a dashboard or output may be real-time, near-real-time, or periodic. A score may change when data, sources, models, weights, benchmarks, refresh schedules, or methodology change.
Outputs are for informational and business-planning purposes and do not guarantee prestige, reputation, media coverage, search ranking, traffic, leads, revenue, customer acquisition, brand value, or other outcomes. Customer remains responsible for independent review, professional judgment, legal compliance, and decisions based on outputs.
A Halo Score is not a consumer report, consumer score, credit score, professional license, certification, audit opinion, valuation, or assurance report. The Services are designed to evaluate business brands and marketing presence, not to rank natural persons or determine employment, credit, housing, insurance, healthcare, education, legal rights, or access to essential services. Those uses are prohibited unless Hanna Creative separately evaluates and expressly authorizes the use in writing.
Hanna Creative may monitor and analyze use of the Services to enforce usage limits, protect security, maintain data and model integrity, investigate suspected violations, and improve performance. Monitoring may include automated detection of scraping, anomalous queries, credential sharing, prompt injection, score manipulation, data poisoning, or attempts to extract proprietary information.
Hanna Creative may restrict, suspend, or terminate access, invalidate an output, remove a designated shareable output, correct a score, or take legal action if it reasonably believes that an output was obtained or used through manipulation, unauthorized access, inaccurate data, violation of the Agreement, or conduct that threatens integrity or third-party rights.
During the subscription term, Hanna Creative may retain Customer Data and Customer-specific processing artifacts as reasonably necessary to provide the Services. Current logs are retained for 14 days and top-page snapshot records older than approximately 190 days are pruned weekly; other active Customer Data is generally retained for the life of the account or brand unless a shorter source-specific rule applies. On source disconnect or brand deletion, local OAuth credentials are designed to be destroyed and further scheduled collection is designed to stop. Administrative hard deletion, any backup expiration, and any manual export are handled under Hanna Creative's operational retention procedures and applicable law; no fixed deletion, backup, or export SLA applies unless an Order expressly states one.
Deletion of Customer Data does not require Hanna Creative to delete or modify independently sourced public or licensed Third-Party Data, lawfully retained security or legal records, non-customer-identifying Usage Data, or Studio Halo Technology. Because the current Service does not train a generalized model or cross-customer benchmark on Customer Data, Hanna Creative does not rely on an "unlearning" exception to preserve a model trained on deleted Customer Data. Any retained personal data remains subject to applicable law and the Agreement.
Certain plans or negotiated Orders may offer additional controls relating to data segregation, retention, publication, dedicated environments, source disclosures, security, or international processing. Hanna Creative does not promise that a particular control is currently available unless the Service, plan, or Order expressly provides it. Any future proposal to use Customer Data for generalized cross-customer AI or scoring improvement will require the affirmative authorization described in Section 8.3.
White-label, API, reseller, agency, or enterprise use may require a separate agreement. No right to white-label, sublicense, resell, expose via API, or provide third-party access is granted by this Policy unless an Order expressly provides it.
Where Hanna Creative processes Customer Personal Data on Customer's behalf under applicable privacy or data-protection law, Schedule 1 to the Terms applies. Approved international processing may require completed GDPR/UK GDPR processor terms, Standard Contractual Clauses or another transfer mechanism, local-representative arrangements, cookie or consent controls, or other safeguards. Where Article 50 of the EU AI Act or a similar transparency rule applies to a Studio Halo feature or output, Hanna Creative and Customer will preserve required AI-interaction notices, labels, or machine-readable markings appropriate to their respective roles. These requirements depend on the actual parties, roles, data, locations, features, and markets and are not automatically satisfied merely because the Services are accessible in a jurisdiction.
Applicable data-security, retention, secure-destruction, breach-notification, processor-contract, and international-transfer obligations are addressed in the Terms, Privacy Policy, Schedule 1, and any required jurisdiction-specific addendum. Massachusetts and Rhode Island requirements remain relevant when their protected information and statutory conditions apply, alongside comparable requirements in other jurisdictions. These provisions describe responsibilities and safeguards; they do not constitute a blanket certification of worldwide compliance or replace the operational programs required by law.
Hanna Creative may update this Policy as provided in the Terms. The updated version will identify its effective date. Material changes to data-use practices will be communicated as required by law or contract. Hanna Creative will not rely on a quiet or retroactive amendment to materially broaden the use of previously collected identifiable or confidential Customer Data for unrelated generalized training; affirmative consent, a new Order, or other valid authorization will be obtained where required by law or an existing commitment.
